Madrid has significantly tightened its vacation rental rules. Since Plan RESIDE, the question is no longer how to process the license, but whether your apartment can qualify as a vacation rental property (VUT). This guide explains, as of today, where it is permitted, what 'independent access' means, and the two permits that confuse almost everyone.

It depends on two things: which zone your apartment is in and whether it has independent access from the street. Under Plan RESIDE, many upper-floor apartments within residential buildings can no longer be converted into new VUTs. For most property owners, this is the decisive filter — not the paperwork.
One figure sums up the situation: of the approximately 16,100 vacation rental properties estimated to exist in Madrid, only around 1,200 operate with a legal license. The window to regularize — and do it properly — is precisely where Fee4Me adds value.
In Madrid, two separate administrations are involved, and one does not replace the other. Registering with the regional registry does not grant you the municipal license, and vice versa.
| Ayuntamiento de Madrid | Comunidad de Madrid | |
|---|---|---|
| What it grants | Urban planning license + tertiary hospitality use (with independent access) | Registration in the Tourism Business Registry → VUT number |
| What it regulates | Where the apartment is located and how it is accessed (Plan RESIDE) | That the property meets tourism requirements |
| Mandatory? | Yes | Yes; the VUT number must appear in all listings |
Plan RESIDE (approved in August 2025 and in force upon publication, replacing the 2019 Special Hospitality Plan) divides the city into zones:
| Zone | New VUT? |
|---|---|
| Historic center (Distrito Centro) | Not in residential buildings; only in exclusively tourist-use buildings (license valid up to 15 years) |
| Designated commercial corridors (more than 26) | Conversions to VUT are not permitted |
| Rest of the city | Yes: on the ground or first floor with independent access, or in entire buildings |
"'Independent access' is what rules out most upper-floor apartments: without a private entrance, there is no new VUT outside exclusively tourist-use buildings."
It is worth knowing because it changes the process: the Supreme Court annulled (ruling of May 21, 2026) the Unique Registry for Short-Term Rentals — the national number under RD 1312/2024, in force since July 1, 2025 — for encroaching on regional competencies. In practice:
Operating as a VUT without the municipal license or without the regional registration is a violation that can result in fines of up to €300,000 in the most serious cases, as well as the immediate cessation of activity and removal of listings from platforms. The amounts depend on how the infringement is classified.
